Findar Terms of Agreement

These Terms govern your use of Findar, operated by The Open Platform Sàrl, Rue des Granges 8, c/o BR, 1204 Geneva, Switzerland ("Findar", "we", "us").

By creating an account or using Findar, you agree to these Terms.

1. Eligibility

Findar is available only to persons 18 years of age or older.

2. Your Responsibility

You are responsible for:

  • The searches and queries you submit to Findar
  • The files, documents, and other information you upload
  • Ensuring that you have the necessary rights and permissions to upload and process such information
  • Verifying information obtained through Findar before relying on it, taking action, or publishing it

Do not upload information that you are not legally permitted to provide to Findar.

3. AI-Generated Results

Findar uses AI models and automated systems to analyse information and produce findings.

AI-generated findings may contain errors, omissions, inaccurate information, or misleading conclusions. Findar does not guarantee that search results or findings are complete, accurate, current, or suitable for a particular purpose.

You remain responsible for independently verifying important information before relying on it.

4. Acceptable Use

You agree not to use Findar unlawfully, to infringe the rights of others, or to upload content that you do not have the right to process.

We may suspend or terminate accounts that materially violate these Terms or misuse the service.

5. Payments and Credits

Findar may be offered through monthly or yearly subscriptions and one-time purchases of search credits.

You may cancel a subscription at any time. Cancellation stops future renewal but does not automatically refund amounts already paid.

For purchased credits, refunds may be requested where the credits have not been used, subject to applicable law and the specific purchase terms presented at checkout. Once credits have been used, payments are generally non-refundable except where a refund is required by applicable law.

Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

6. Availability and Changes

We aim to keep Findar available and reliable but do not guarantee uninterrupted or error-free service.

We may modify, improve, suspend, or discontinue parts of Findar when reasonably necessary, including for security, technical, or business reasons.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Findar is not responsible for losses arising from:

  • Errors or inaccuracies in AI-generated findings
  • Your reliance on information without independently verifying it
  • The content of searches or files submitted by you
  • Actions you take based on Findar's results
  • Temporary interruptions, technical failures, or loss of availability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

8. Account Termination

You may stop using Findar and request deletion of your account at any time.

We may suspend or terminate an account where necessary to protect Findar, other users, or our services, or where these Terms are materially violated.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, subject to any mandatory consumer protections that apply to you under applicable law.

To the extent legally permitted, disputes arising from these Terms or your use of Findar shall be submitted to the competent courts of Geneva, Switzerland.

Nothing in this section prevents a consumer from exercising mandatory rights to bring proceedings in another jurisdiction where such rights cannot legally be waived.
